10 CRITICAL VALIDATIONS YOU MUST DEMAND FROM YOUR FIRING RANGE LEAD RECLAMATION CONTRACTOR TO PROTECT YOU AND YOUR RANGE:
Prior to entering into a firing range services contract, you must determine what is required to ensure a satisfactory outcome and to protect your range, managing all of the potential liabilities short and long term. We encourage you to ask all contractors bidding your work each of the questions below and request the documentation to prove compliance. This is essential to fully protecting yourself and your range.
1. Contract type
Does the contractor provide you with:
a) Performance protection to guaranty their service? If they are not delivering on their promises, can they be fired? Shouldn’t a qualified contractor stand by its work? We think so! We provide “Firm Fixed” pricing. Others leave the door open for large change orders.
b) Comprehensive contract with FULL owner-indemnification to protect and defend against all contractor activities to address the sizable potential liability and exposure to the range.
c) The contract must require full compliance to all local, state and federal laws and regulations.
- Others: offer a contract that locks you in for the entire year (or more!) with no chance of the range to back out for poor contractor performance or lack of timely scheduling.
How would it feel as the range owner/manager to be locked in and stuck for the next 12 months? - MT2: provides a standard one-time contract or annual contract based on performance.
If we don’t perform to your satisfaction, provide us a notification and we work with you to fix it.

2. Reclaimed Lead Payout and Waste Costs
a) Shouldn’t your range demand the absolute highest value for your range lead as well as the lowest waste processing cost? (filters)
- Others: offer a basic contract that would give you less than 50% of the LME value for your lead.
- You should not have to pay more because they have chosen to work with unnecessary layers of expense! Shouldn’t you pay attention to the value you receive for your recycled lead and the cost to properly dispose of your waste?
- MT2: provides you with a contract that typically pays you between 60% – 80% of LME for your lead! Plus, we offer to treat your lead wastes to dispose of as non-hazardous.

b) Distribution of Lead/Brass Recycle $$: Do you want a contractor that holds proceeds from your recycled metals for a month, or do you want prompt payment of those proceeds? Don’t you want your money now?
- Others: On top of paying below LME market value per pound they either offer use of proceeds at Retail prices in their own store or pay out cash one month later.

3. Regulatory Compliance Validation:
- Contractor must provide listing of any and all previous regulatory or OSHA fines and/or violations and provide a detailed written Work Plan and Health and Safety Plan approved by a CIH or CSP.
PROOF: Require written documentation validating any regulatory/OSHA fines or violations. Request upfront to review their Work and Health and Safety Plans for completeness, checking for a CIH/CSP approval.
4. Waste (filters etc.) Management and Disposal Protection: Range Owner Protection
- Unfortunately there have been many contractors convicted of violating waste laws!
Contractor must provide documentation on planned project work and waste management activities to ensure compliance with state and federal RCRA waste disposal requirements including prior completed manifests documenting legal waste disposal. Must provide certification and DOT Manifests for all transport, & disposal, Do NOT take the contractor’s word for it or let them put the waste in their truck. Get it in writing. - Others: attempt to offer you a contract in the name of an unknown shell company that will hold the potential waste violations! Why would they do that? The waste generator (the range) is responsible for proper and lawful disposal of the range’s waste-no matter what! Who is there to protect you when the contractor unlawfully transports/disposes of your waste and the EPA and state come looking for answers or to issue fines?

- PROOF: Review qualifications of who is actually handling/disposing of your waste, require Table of Contents from Work Plan & Waste Management Plan and several previous completed waste manifests for hazardous waste disposal. Request Lead Liability Insurance to protect you.
5. Insurance Validation:
Require comprehensive insurance coverage providing independent financial protection to the range should an issue arise. Coverages must include General Liability (site and structures), Workers Comp, and Pollution Liability addressing all lead work activities.
Recommended minimum is $5,000,000 General AND Pollution Liability. Pollution Liability is the only available coverage for lead on the range or for hazardous materials.
PROOF: Require a current Certificate of Insurance in the name of the range and its Managers/Owners validating the levels of coverage. 6. Financial Validation:
Contractor must be able to document, with audited financials, sufficient company assets:
a) to finish your project, not just take your lead and b) allow it to sustain defending you against a claim or actual violation without going bankrupt, leaving your range unprotected and exposed. (Suggested minimum $1,000,000)
PROOF: Require a notarized CPA audit letter confirming company assets.
When performing renovations & construction, contractor must be required to provide a payment-performance bond.
PROOF: Require a bond letter validating coverage, MT2 is bondable up to $20,000,000
7. Safety & Health Compliance Validation:
Comprehensive written work and safety/health plans specific to the range. Make sure the contractor and workers are up to date with state & federal OSHA compliance. Must provide current training and OSHA worker certificates for each worker (must be within past 12 months).
PROOF: Require written plan review and 1) Current OSHA worker certificates for each worker. 2) Review Table of Contents for HASP to confirm comprehensive training and procedures. 3) Current respirator fit test 4) Documentation validating no prior OSHA fines or violations.

The company you choose must be of sufficient business size with regional presence and sufficient operating capacity utilizing specialized equipment to handle your specific needs without delays or performance issues. Unfortunately, not all Range Contractors “are created equally” and numerous Range Managers/Owners have discovered the differences the hard way. 9. Project History Validation:
